Terms of Service

1. Acceptance of Terms

By accessing and using the services provided by Fizyonops Yazılım Limited Şirketi ("Fizyonops", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Fizyonops provides technology consultancy services including but not limited to DevOps transformation, Kubernetes consulting, cloud migration, observability solutions, CI/CD automation, and AI-powered infrastructure solutions. The scope, deliverables, and timeline of each engagement will be defined in a separate Statement of Work (SOW) or service agreement.

3. Client Obligations

You agree to provide timely access to systems, documentation, and personnel necessary for us to deliver the agreed-upon services. You are responsible for maintaining backups of your data and systems prior to any engagement. You agree not to misuse our services or use them for any unlawful purpose.

4. Intellectual Property

All pre-existing intellectual property remains the property of its respective owner. Custom deliverables created specifically for you during an engagement will be assigned to you upon full payment, unless otherwise stated in the SOW. Fizyonops retains the right to use general knowledge, techniques, and methodologies developed during engagements.

5. Payment Terms

Payment terms are specified in each SOW or service agreement. Invoices are due within 30 days of issuance unless otherwise agreed. Late payments may incur interest at the rate specified by Turkish Commercial Code. We reserve the right to suspend services for overdue payments.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement. This obligation survives the termination of the agreement for a period of two (2) years.

7. Limitation of Liability

To the maximum extent permitted by law, Fizyonops's total liability for any claims arising from or related to the services shall not exceed the total fees paid by you in the twelve (12) months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

7a. AI-Powered Features and FizyonAI

FizyonAI and AI-powered features such as the Kube Hammer AI Assistant and Recipe Builder are provided on an "AS IS" and "AS AVAILABLE" basis. AI-generated output - including but not limited to kubectl commands, YAML manifests, diagnostic suggestions, and operational advice - may be inaccurate, incomplete, or inappropriate for your environment.

Fizyonops makes no warranty regarding the accuracy or fitness of AI output for any purpose. You are solely responsible for reviewing and validating all AI-generated suggestions before applying them to production or non-production systems.

FizyonAI is currently in beta. Model behavior, quota allocations, and feature availability may change without notice. FizyonAI Cloud bills by 16,384-token context windows. A fairness mechanism allows credit recovery for verified misunderstandings and hallucination reports. Credit recoveries are determined by automated classifiers and human review at Fizyonops's sole discretion.

When using FizyonAI Cloud mode, query text and cluster context metadata are transmitted to Fizyonops-hosted infrastructure. You may configure local data redaction patterns to prevent sensitive content from leaving your machine. When using Local AI mode (BYOK/Ollama), no data is transmitted to Fizyonops. Fizyonops is not liable for any consequences of actions taken based on AI output regardless of the mode used.

8. Termination

Either party may terminate a service engagement with 30 days' written notice. Upon termination, you shall pay for all services rendered up to the termination date. Sections regarding confidentiality, intellectual property, and limitation of liability survive termination.

9. Governing Law

These terms are governed by the laws of the Republic of Turkey. Any disputes arising from these terms shall be resolved in the courts of Bursa, Turkey.
